Looking for mortgage & loan advice?

A mortgage is a loan secured against property. If you stop paying, the lender can sell the property to recover the money. That's why it's important to understand what you're signing and what happens next.

We help with the legal side of mortgages and loans, including family loans. We explain each step in plain English, so you can make decisions with confidence.

Areas we can help with

  • Discharging a mortgage once your loan is paid out

  • Transferring or refinancing a mortgage

  • Family loan agreements, including the bank of mum and dad

  • Guarantor arrangements and independent legal advice

  • Second mortgages and private loans

Understanding mortgages & loans

Loans are used in many ways, and the documents involved need to be done correctly and registered. A discharge of mortgage releases the lender's interest in your property once your loan is paid out and needs to be registered on your title so the mortgage is removed. A transfer of mortgage moves a mortgage from one lender to another. We explain when each is used and handle the legal steps.

Tailored advice for your situation

Every borrower and lender is different, so we shape our advice on your specific circumstances.

Paid off your loan? We make sure the mortgage is properly discharged from your title.

Refinancing? We help with the legal steps when you move your loan to a new lender.

Lending to your children? A clear written agreement makes clear whether money is a loan or a gift, how it will be repaid and what happens if circumstances change. A family loan can also be secured by a registered mortgage over the property.

Borrowing from family? We help you understand the terms, repayments and what happens if circumstances change.

Asked to be a guarantor? You can become responsible for the loan if the borrower can't repay it. We explain the risks clearly and provide independent advice.

Separating? We help you deal with a joint loan or remove someone from a mortgage or title. The lender must usually agree.

What are the potential risks?

Mortgage and loan documents have legal consequences long after you sign, so it is important to understand them before you commit. Documents such as a discharge or transfer of mortgage also need to be done correctly and registered on your title to take effect.

Frequently Asked Questions

Answers to the questions we hear most often about mortgages and loans.

What is a discharge of mortgage?

It's a document that releases the lender's interest in your property once your loan is paid out. It needs to be registered on your title so the mortgage is removed.

What is a transfer of mortgage?

A transfer of mortgage is a document that moves a mortgage from one lender to another. It needs to be done correctly and registered. We can explain when it's used.

Do I need a written agreement for a family loan?

It's strongly recommended. A written agreement makes clear whether money is a loan or a gift, how it will be repaid and what happens if circumstances change.

Can a family loan be secured against a property?

Yes. A loan between family members can be secured by a registered mortgage over the property. We can advise whether this suits your situation.

I've been asked to be a guarantor. What should I know?

As a guarantor, you can become responsible for the loan if the borrower can't repay it. Lenders often ask you to get independent legal advice first. We can explain the risks clearly.

Can I take someone off a mortgage or title?

Often, yes, but the lender must usually agree, and the title may need to be changed. This is common after separation. We can help you through it.

What is your pricing?

At Harriss Jones Lawyers, after meeting with you to find out what you need, we will provide you with clear information on our professional fees that is specific to your matter.  For more information get in touch with our team.
